• Impersonating or attempting to impersonate Pinshead, a pinshead.info employee, another user, or any other person or entity.
• Engaging in any other conduct that restricts or inhibits anyone's use or enjoyment of the services, or which may harm Pinshead or users of the services or expose them to liability.

4. Prohibited Activities

In addition to the Acceptable Use Policy, you agree not to engage in any of the following prohibited activities:

• Using the services to violate any applicable federal, state, or local law or regulation.
• Attempting to gain unauthorized access to the services, other accounts, computer systems, or networks connected to the services, through hacking, password mining, or any other means.
• Transmitting any viruses, worms, malware, or any other harmful code.
• Using any robot, spider, or other automatic devices, process, or means to access the services for any purpose, including monitoring or copying any of the material on the services.

Any violation of this section may result in immediate termination of your access to the services without prior notice and may expose you to civil or criminal liability.

5. Content Ownership

All content, features, and functionality on the services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, and software, are the exclusive property of Pinshead or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the services for your personal or internal business purposes. This license does not include any resale or commercial use of the services or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the services or its contents; or any use of data mining, robots, or similar data gathering and extraction tools.

All rights not expressly granted to you in these Terms of Service are reserved by Pinshead. Any unauthorized use of the services or its contents will terminate the permission or license granted by Pinshead.

6. User-Generated Content

Users may have the opportunity to submit, post, or otherwise transmit content through the services ("User-Generated Content"). By submitting User-Generated Content, you grant Pinshead a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that you own or control all rights to the User-Generated Content you submit and that the User-Generated Content is accurate, not confidential, and does not violate any contractual restrictions or other third-party rights.

Pinshead reserves the right to remove or edit any User-Generated Content for any reason, including but not limited to violations of these Terms of Service or applicable laws.

7. Payment Terms

Access to certain features of the services may require payment of fees. You agree to pay all fees and charges associated with your use of the services in accordance with the billing terms in effect at the time of your purchase. All fees are non-refundable unless otherwise stated in writing by Pinshead.

Payment must be made using a valid payment method as specified during the registration process. You are responsible for maintaining the confidentiality of your payment information and for all transactions made under your account.

Pinshead reserves the right to change its pricing and billing policies at any time. Any changes will be communicated to you in advance, and your continued use of the services after such changes constitutes your acceptance of the new pricing and billing policies.

8. Service Modifications

Pinshead reserves the right to modify or discontinue, temporarily or permanently, the services (or any part thereof) with or without notice. You agree that Pinshead will not be liable to you or to any third party for any modification, suspension, or discontinuance of the services.

We may also impose limits on certain features and services or restrict your access to parts or all of the services without notice or liability. Any new features or tools that are added to the current services shall also be subject to these Terms of Service.

It is your responsibility to review these Terms of Service periodically for updates. Your continued use of the services after any modifications to the Terms of Service will constitute your acceptance of such modifications.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Pinshead, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not Pinshead has been informed of the possibility of such damage.

In no event shall Pinshead’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the services during the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

10. Termination

These Terms of Service are effective until terminated by either you or Pinshead. You may terminate these Terms of Service at any time by discontinuing your use of the services and deleting your account. Pinshead may terminate these Terms of Service or suspend your access to the services at any time, without notice, for conduct that Pinshead believes violates these Terms of Service or is harmful to other users of the services, Pinshead, or third parties, or for any other reason.

Upon termination of these Terms of Service, your right to use the services will immediately cease. All provisions of these Terms of Service that by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Termination of your account does not relieve you of any obligation to pay any outstanding fees or charges incurred prior to termination.
